DSHS’s March 31 consumable hemp rules remain in effect while the case moves through the appeals process. THBC filed a brief on August 14th, and the State has until September 17th to respond.
Read the lawsuit updateEffective July 31, delta-8 and other non-delta-9 THC isomers are Schedule I controlled substances in Texas. Only naturally occurring trace amounts in hemp are exempt.
View the DSHS notice (opens in a new tab)Congress delayed most changes to the federal hemp definition until December 11, 2026. Restrictions on cannabinoids that cannot be naturally produced by cannabis still take effect November 12.
