The State filed its reply brief on September 17th. The next step is a submission notice from the Fifteenth Court of Appeals which will tell the parties when the court intends to decide the appeal based on the written briefs or schedule oral arguments.
Read the lawsuit updateEffective July 31, delta-8 and other non-delta-9 THC isomers are Schedule I controlled substances in Texas. Only naturally occurring trace amounts in hemp are exempt.
View the DSHS noticeCongress delayed most changes to the federal hemp definition until December 11, 2026. Restrictions on cannabinoids that cannot be naturally produced by cannabis still take effect November 12.
